The Family Law System has undergone significant changes over the past few years. This unit is updated to align with recent amendments to the Family Law Act 1975.

It is a core unit in the CHC81115 Graduate Diploma of Family Dispute Resolution, and you can choose to complete the training as Professional Development only (without assessment and a Statement of Attainment) or enrol with our Partnered Registered Training Organisation and earn a Statement of Attainment.


The unit is a core unit unit in the following qualifications: 

 - CHC81115 - Graduate Diploma of Family Dispute Resolution  

It is also an elective unit in the following qualifications:  

- CHC81015 - Graduate Diploma of Relationship Counselling  

-CHC52021 - Diploma of Community Services 

-CHC42021 - Certificate IV in Community Services  

The Statement of Attainment option is delivered through a training partnership with RTO Inspiritive 21178. Mediation Institute provides all training and assessments. Inspiritive provides Quality Control and Validation.

Pre-requisites

There is no pre-requisite for enrolling in this unit of competence making it a good first step for people interested in a career as a Family Dispute Resolution Practitioner who may not yet hold pre-requisities required to enrol in the full qualification.

Why do a single unit and not the full Qualification?

There are a few reasons why you may choose to do the training unit by unit.

No Pre-requisites

There are no pre-requisites to enrol in this unit of competence. If you don’t yet meet the pre-requisite requirements to enrol in the CHC81115 – Graduate Diploma of Family Dispute Resolution but would like to get started this is the perfect first step. 

For example, if you are completing a law degree or other bachelors or higher qualification which will allow you to enrol in the Grad. Dip. but you wanted to get started on your journey to becoming a FDRP right now. 

Another example would be if you are completing the training, assessment and accreditation to become an accredited mediator but would like to get started on your FDR studies as well. 

Start with a manageable chunk

If it has been a long time since you studied at a high level or you are unsure about being able to fit study in with work and care giver responsibilities this is a great way to try before committing to the full qualification. 

Note: If you do not meet the pre-requisites for enrolment in the full graduate diploma this is not a back door way of gaining it without pre-requisites. You can do a few individual units but we won’t be able to issue the full qualification without you eventually meeting the pre-requisite requirements. 

How is it taught?

This course is delivered through online learning.  

You can undertake the course and assessment for competence from anywhere in Australia. You can even do the course outside of Australia if you want to update your knowledge of the Australian family law system.

The learning of theory:  The online learning offers us the ability to provide you with a comprehensive course structure allowing you to access information, view recorded webinars, participate in live sessions (if available), and undergo various assessment tasks. This ensures you acquire the necessary knowledge to operate as a FDRP within the family law system.

  • Knowing the different points at which services can be provided within the family law system for prevention, assessment, and intervention and support services. 
  • The needs of different clients within the family law system and how to respond to issues related to:
    • domestic and family violence
    • finances and spousal support
    • property settlements and issues related to property
    • children and developing parenting agreements as well as how parents can make their agreements enforceable court orders
    • relationship conflict and strategies to assist clients to understand the consequences of exposing children to conflict
  • Systems and processes within the family law environment
  • Commonwealth Family Law Legislation and how it applies in practice
  • State and Territory Family Violence Legislation
  • Commonwealth Child Support Legislation
  • Freedom of Information and Privacy Legislation
  • Duty of Care requirements when working with families within the family law system
  • Where to seek expert clarification of family law
  • Family dynamics in different cultures and how this may impact the provision of services
  • Referral options and systems that are available to clients whose needs may best be met by other services or experts.

  • For registered FDR Practitioners seeking to keep their professional knowledge up to date.
  • Tailored for family dispute resolution practitioners or intake officers. It is also relevant is for family relationship counselling, children’s contact services,  and other sectors within the family law system.

Can I get RPL?

You will be able to propose alternative assessment evidence if you have evidence from the workplace that you believe demonstrates your skills and knowledge.  

As this unit is offered as a course there is no discount for RPL if you also want access to the course materials. 

Course Duration

The nominal duration for the unit is 75 hours according to the 2024 Victorian Purchasing Guide.

We have scheduled the course to be completed within 30 days of the close date for enrolment for the course groups which is at the middle of each month.  

Required Knowledge for FDR Practitioners

This unit covers required knowledge that is essential for Family Dispute Resolution Practitioners as well as  others working in the family law context. 

Skills Development


Skills development:
 you will develop your ability to apply the knowledge in real life scenarios through case studies, discussions, the use of documentation and systems.

Knowledge and Skills Assessment


Your knowledge will be demonstrated quizzes, written tasks, case study and a portfolio of completed documents and tasks. 

You can provide workplace evidence (if you are working within a dispute resolution or family law environment)

 If you are not already an FDR practitioner or working in an allied environment we will discuss the suitability of the course with you before you enrol. 

This unit describes the skills and knowledge required to determine and respond to family law requirements, work collaboratively within the family law system, and contribute to improved work practices linked to family law.

The three elements that you will demonstrate competence in are:

  1. Determine and respond to family law requirements
  2. Collaborate with others in the family law system
  3. Contribute to workplace improvements

Performance Evidence

There must be evidence that the candidate has:

  1. correctly applied family law to at least 5 different client situations, that individually or cumulatively include needs relating to domestic and family violence/safety, finance, property, children, relationship conflict
  2. demonstrated effective use of the following in the context of family law. Systems and processes, documentation, reporting and collaboration with others in the system
  3. developed appropriate responses to at least 5 different legal or ethical dilemmas in the family law context
  4. identified and analysed at least 3 work practices in terms of how they meet family law responsibilities and what improvements could be made.

During the course you will demonstrate competence in role plays and simulations and then apply them in the workplace. If you are completing this unit as a stand alone course it is acceptable for all assessment to be completed in a simulated environment that simulates workplace conditions.

Delivery
