What does NMAS Mean?

NMAS Membership

NMAS is an acronym for National Mediator Accreditation System.

It is a voluntary industry standard for mediators to show that they have been trained, assessed for competence, have demonstrated that they are of good character and have insurance.

To maintain their NMAS Accreditation they need to participate in continuing professional development and be doing mediation work.

Using a mediator who is not NMAS Accredited risks getting someone who does not uphold the ethical standards and who may not even be trained in mediation.

Our recommendation is don’t work with someone who says they are a mediator but has not bothered to become NMAS Accredited.

How can I tell if a Mediator is NMAS Accredited?

There is a public register of NMAS Accredited Mediators. If they are not on the register they are not a current Accredited Mediator through NMAS.

What does “Accredited By” mean on the register?

The NMAS System is administered by the Mediators Standards board, but they have delegated authority for the actual accreditation process to Recognised Mediator Accreditation Bodies (RMAB’s) such as Mediation Institute.

The RMAB checks eligibility for the mediators accreditation and renewals every two years. They are also often, but not always, the independent complaint handling service for the mediator.

What is an independent complaint handling service?

The NMAS System in addition to providing guidance for how mediators need to be trained and assessed provides the industry with a set of practice standards which make sure that mediators work in a legal and ethical way upholding the principles of mediation in their work.

If a client has an issue with a mediator that isn’t able to be resolved they can escalate their complaint to the mediators independent complaint handling service. The information about how to make a complaint should be freely available to all NMAS Accredited mediator’s clients, usually in their agreement to mediate.

Gil Avenaim

Gil Avenaim is an ACCREDITED FAMILY DISPUTE PRACTITIONER, MEDIATOR, LIFE COACH and TRAINER who has spent many years navigating the Family Law system in an effort to understand the best ways to achieve a mutually suitable outcome for those parties involved.  Having been exposed himself to the ‘system’ whilst trying to obtain a suitable outcome on parenting, Gil quickly realised that the right Mediation or Family Dispute Resolution (FDR) would achieve a faster and richer outcome. Not only would he save a small fortune in legal fees by using a Mediator, allowing that money to be better spent contributing to his child’s future needs, but he would also achieve a much faster outcome, and be able to spend more time with his child sooner.

This all sounded great in theory except for a few hiccups…

1) The Mediators or Practitioners who were recommended to Gil initially, and whom he used for a handful of sessions, did not address the core issues effectively, and seemed totally satisfied with a ‘few minor wins’. When the pressure was on to address the big issues and both parties started to ‘dig in’ refusing to concede, these Mediators defaulted to ‘well there’s not much else we can do here!”.

This did not help, it was wasted money, and it slowed down the whole process. A better understanding of the legal process, the time it would take to achieve an outcome, and the costs involved in taking this to a final hearing could have been explained at that point, and a stronger approach could have been adopted in trying to get both parties to explore other options.2) The result of failed Mediation meant a protracted legal battle, a lot of stress and angst, no immediate resolutions or outcomes, and more legal costs. Unfortunately ‘egos’ and a ‘need to win’ do come into play when parties are going down this road. Many times parties cannot see the forest from the trees, and feel that Lawyers, Barristers and Judges are the only ones who can solve their problems. The reality is that the Court system today is totally ‘choked’ as a result of Judges retiring, far too many matters on the list, and long lead times. For those recently separated or divorced choosing to take their matter to Court, expected case durations are now between 2 to 3 years.

3) The Courts, Lawyers, Barristers, Independent Expert Witnesses, Psychologists, Therapists, Children’s Lawyers, Counsellors and others do err on the side of conservatism and caution in respect of what should be done with the children…and rightly so…. therefore the process in achieving an outcome is painfully slow, frustrating and expensive….especially if one party decides to stall or not cooperate, preferring to let the system run its natural course.

MEDIATION or FAMILY DISPUTE RESOLUTION actually works providing:-
a) You use a Mediator or Practitioner whose focus is the child / children and what’s best for them
b) You use a Mediator or Practitioner who has ‘been there and done that’, and understands how the legal process works
c) You use a Mediator or Practitioner who has the strength and conviction to keep fighting for both of you so you do achieve a mutually beneficial outcome
d) You use a Mediator or Practitioner who is easy to talk to, calm, and has strong communication and negotiating skills
e) You use a Mediator or Practitioner who will help you keep the costs down and will only recommend third party involvement when it is absolutely necessary.

NMAS Accredited Mediator / New Ways for Families Coach

I work in co-operation with parents to craft Parenting Plans that help to empower separated parents to take responsibility for the important decisions about caring for their children.

Early intervention in separation and divorce mediation is also the key to resolving these disputes effectively, this remains particularly true during separation and divorce mediation. Quick and caring resolution in these matters is paramount, especially during what can be a difficult and painful time.

I also mediate property settlements and family issues not related to divorce or separation. Avoiding lawyers and the courts is not only a less expensive way to find resolution it is a more caring and less stressful way to deal with a difficult situation. MJB and ISDR offers a child inclusive practice where the family and children are assisted in a calm and neutral environment.
